29 CFR 1910.1000(a)(2): An employee's exposure to any substance in Table Z-1, the exposure limit of which is not preceded by a "C", shall not exceed the 8-hour Time Weighted Average given for that substance any 8-hour work shift of a 40-hour work week. (a) On or about August 9, 2023, an employee engaged in welding operations, welding station #19 was exposed to dust that exceeded the permissible exposure limit (PEL) while performing routine fabrication of manufactured products. The employee was exposed to an 8-hour time weighted average (TWA) of 18.35 mg/m3 of dust, which was approximately 1.22 times the Permissible Exposure Limit (PEL) of 15mg/m3 for the total dust fraction of particulate not otherwise regulated (PNOR) during the 262 minute sampling period sampled. Zero exposure assumed for the unsampled period of 218 minutes. (b) On or about August 9, 2023, an employee engaged in welding operations, welding station #4 was exposed to dust that exceeded the permissible exposure limit (PEL) while performing routine fabrication of manufactured products. The employee was exposed to an 8-hour time weighted average (TWA) of 18.71 mg/m3 of dust, which was approximately 1.24 times the Permissible Exposure Limit (PEL) of 15mg/m3 for the total dust fraction of particulate not otherwise regulated (PNOR) during the 405 minute sampling period sampled. Zero exposure assumed for the unsampled period of 75 minutes. (c) On or about August 9, 2023, an employee engaged in welding operations, welding station #17 was exposed to dust that exceeded the permissible exposure limit (PEL) while performing routine fabrication of manufactured products. The employee was exposed to an 8-hour time weighted average (TWA) of 23.51 mg/m3 of dust, which was approximately 1.56 times the Permissible Exposure Limit (PEL) of 15mg/m3 for the total dust fraction of particulate not otherwise regulated (PNOR) during the 395 minute sampling period sampled. Zero exposure assumed for the unsampled period of 85 minutes.

29 CFR 1910.1000(e): To achieve compliance with paragraphs (a) through (d) of this section, administrative or engineering controls must first be determined and implemented whenever feasible. When such controls are not feasible to achieve full compliance, protective equipment or any other protective measures shall be used to keep the exposure of employees to air contaminants within the limits prescribed in this section. Any equipment and/or technical measures used for this purpose must be approved for each particular use by a competent industrial hygienist or other technically qualified person. Whenever respirators are used, their use shall comply with 1910.134. At the facility located at, W210N12975 Gateway Crossing Germantown, Wisconsin; the employer did not determine and implement feasible administrative or engineering controls to achieve compliance with paragraph (a) of this section: (a) On or about August 9, 2023, the employer did not implement proper engineering and administrative controls to reduce employee exposures below the permissible exposure limit (PEL) for the total dust fraction of particulate not otherwise regulated (PNOR) for employees performing routine production welding. Three employees engaged in welding operations had exposures that exceeded the PEL for PNOR on this sampling date (see citation 1 item 1a instances a. through c. for exposure information.)
