On or about July 6, 2023 and continuing, employees were operating powered industrial trucks (PIT) including but not limited to end riders on a daily basis after being involved in an accident without undergoing refresher training. The employer did not ensure the operators were provided with refresher training after the accident.

29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement. a) Sysco Syracuse, LLC., 2508 Warners Road, Warners, NY - Throughout the warehouse. On or about July 6, 2023 and continuing employees were operating powered industrial trucks (PIT) including but not limited to end riders on a daily basis without ensuring controls were neutralized and brakes were set to prevent movement when dismounting the lift to retrieve materials from the racking system. The employer did not ensure the PIT operators neutralized controls and set the brakes to prevent movement. This resulted in a serious injury.
