29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   The job site located at 2027 Southwest Wannamaker Road Topeka, Kansas, employees engaged in trenching and excavation activities were exposed to struck-by hazards. The employer did not provide hazard recognition training for employees performing construction activities such as operating Bobcat excavator with other employee underneath and inside the trench, operating Bobcat on the pile of dirt above the open trench, working inside the trench, under the bucket to guide the E60 (1260647) Bobcat excavator operator to go up or down, low or high, working inside the trench without ladder for access.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  The job site located at 2027 Southwest Wannamaker Road Topeka, Kansas, employee(s) engaged in trenching and excavation activities were exposed to egress hazards while working inside of a trench to guide the E60 (1260647) Bobcat excavator operator to go up or down, low or high.  The employee(s) were allowed to stand underneath the excavator's bucket while performing the laser measurements of the depth/the grade of the excavation, checking the elevation of the dirt to signal the operator to dig up or down. Employer failed to provide a stairway or ladder for employees to access to and from inside the trench.

The employee(s) were allowed to stand underneath the excavator's bucket while performing the laser measurements of the depth/the grade of the excavation, checking the elevation of the dirt to signal the operator to dig up or down.
