OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were traveling by foot within the swing radius of a Caterpillar brand excavator (model number: 326FL, serial number CAT0326FPWGL00229*): Jobsite, 318 Forrest St Cohasset MA. 02025: On or about July 7, 2023, employee was exposed to struck-by and crushed-by hazards while working on foot between the excavator and excavated foundation of a residential construction site.
