29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) Jobsite at 3001 Oxford Street, Philadelphia, PA- On or about July 10, 2023, the employer failed to provide the employee with information/training on the hazardous chemicals in their work areas.  Employee exposed to chemicals, including but not limited to:  -Oxidized asphalt and re-refined engine oil bottoms as contained in United Asphalts LO SMELL Oxidized Asphalt Type III.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Jobsite at 3001 Oxford Street, Philadelphia, PA- On or about July 10, 2023, the employer did not ensure that an employee working on ground level was protected by use of a protective helmet from falling or flying objects. An employee was operating the tar kettle on the ground level without head protection while employees discarded materials from the roof at least approximately 30 feet above, thereby exposing employees to struck-by and overhead hazards.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) Jobsite at 3001 Oxford Street, Philadelphia, PA- On or about July 10, 2023, the employer did not ensure that the employee utilized eye or face protection when exposed to hot liquified asphalt while operating the tar kettle on the ground level of the jobsite.   Employee was exposed to potential eye or face hazards resulting from exposure to chemicals, including but not limited to:  -Oxidized asphalt and re-refined engine oil bottoms as contained in United Asphalts LO SMELL Oxidized Asphalt Type III.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  a) Jobsite at 3001 Oxford Street, Philadelphia, PA- On or about July 10, 2023, the employer did not ensure that each employee engaged in residential construction activities 6 feet or more above lower levels were protected by guardrail systems, safety net system, or personal fall arrest system.  Employees were working from the roof of a three story residential building without fall protection, exposing employees to falls of at least approximately 30 feet from ground level and/or 10 feet from next lower level.
