29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. On or about, Jacobus Energy, LLC did not ensure that flame-resistant and/or fire retardant treated clothing was worn by employees to protect their bodies from burns. Employees were exposed to flash fire and chemical hazards from loading and unloading fuel from a tank truck.

29 CFR 1910.132(d)(1)(i): When the employer assessed the workplace hazard(s) and determined that hazard(s) were present, which necessitated the use of personal protective equipment (PPE), the employer did not select and have each affected employee use the types of PPE that would protect the affected employee from hazards identified in the hazard assessment. On or about July 3, 2023, and prior thereto, Jacobus Energy, LLC did not select the types of PPE that would protect the affected employee from burn hazards identified in the hazard assessment. The hazard assessment did not identify the selected PPE nor the types of PPE.
