29 CFR 1910.1048 (d)(2): Employees who may have been exposed at or above the action level or short-term exposure limit (STEL) were not identified, and the exposure was not accurately determined for each identified employee:  Embalming Room:  On or about July 07, 2023, and sometime thereafter, employee exposure to formaldehyde vapors, which may have been at or above the 0.5 parts per million (ppm) action level or the 2 ppm STEL, were not identified by the employer for each employee using aqueous solutions of embalming fluid containing formaldehyde (formalin).  Products used by employees to embalm the human body included, but were not limited to, an Introfiant DC 30 Index and a Metasyn Accelerated 24 Index arterial solution containing approximately 50 percent formaldehyde and 10 percent methanol.

29 CFR 1910.1030(d)(2)(i): Engineering and work practice controls were not used to eliminate or minimize employee exposures:  Embalming Room:  On or about July 07, 2023, and sometime thereafter, employees exposed to bloodborne pathogens, and other potentially infectious material (OPIM), did not use engineering and work practice controls as a primary means to eliminate or minimize exposures while handling human bodies. The employer failed to evaluate work practice controls and the types of engineering controls available to determine their appropriateness and effectiveness during embalming-related procedures. These procedures included, but were not limited to, making arterial incisions with scalpels that were not safety-engineered and practices   that failed to use the appropriate containers immediately after sharps became contaminated.
