29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  On or about July 6, 2023, employees were exposed to fall hazards to a lower level when accessing work platforms located on the sides of grain bins and the employer had not ensured a suitable fall protection system was used in the following instances:  a.)	Employees working from a platform on the west side of West Bean Bin Number T05 were exposed to fall hazards of 6 feet and a guardrail system was not installed along all open sides.  b.)	Employees working from lower and upper platforms on the south side of West Bean Bin Number T05 were exposed to fall hazards of 10 feet and 16 feet respectively, and a guardrail system was not installed along all open sides.  c.) Employees working from the lower platform on the south side of West Concrete Bin were exposed to fall hazards of 8 feet and a guardrail system was not installed along all open sides.  d.) Employees working from lower and upper platforms on the south side of East Concrete Bin were exposed to fall hazards of 6 feet and 15 feet respectively, and a guardrail system was not installed along all open sides.  e.)	Employees working from a platform on the south side of Bin Number 15 were exposed to fall hazards of 6 feet and a guardrail system was not installed along all open sides.  f.)	Employees working from a platform on the south side of Bin Number 16 were exposed to fall hazards of 9 feet and a guardrail system was not installed along all open sides.  g.)	Employees working from a platform on the north side of Bin Number 16 were exposed to fall hazards of 8 feet and a guardrail system was not installed along all open sides.  h.)	Employees working from lower and upper platforms on the south side of Bin Number 17 were exposed to fall hazards of 8 feet 6 inches and 17 feet respectively, and a guardrail system was not installed along all open sides.  i.)	Employees working from lower and upper platforms on the north side of Bin Number 17 were exposed to fall hazards of 8 feet and 16 feet respectively, and a guardrail system was not installed along all open sides.  j.)	Employees working from the loadout platform on the north side of the Concrete Bins were exposed to fall hazards of 10 feet and a guardrail system was not installed on the east and west ends.

29 CFR 1910.28(b)(3)(i): The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D):   On or about July 6, 2023, employees were exposed to fall hazards of approximately 15 feet to a lower level when working from the upper platform located on the south side of the West Concrete Bin and the employer had not ensured a suitable fall protection system was used.

29 CFR 1910.28(b)(11)(ii): The employer did not ensure that each flight of stairs having at least 3 treads and at least 4 risers is equipped with stair rail systems and handrails as described in 29 CFR 1910.28 Table D-2-Stairway Handrail Requirements.   On or about November 27, 2023, an employee was exposed to fall hazards above 4 feet to a lower level when using the stairs leading to the House Basement and the employer had not ensured a suitable stair rail was installed along the open sides of the stairs.

29 CFR 1910.157(g)(2): The educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting was not provided to all employees upon initial employment, and at least annually thereafter:   On or about November 27, 2023, an employee was exposed to fire hazards when required to extinguish incipient stage fires with a portable fire extinguisher during Hot Work and Emergency Action Procedures and the employer had not trained the employee annually in the topics required by the standard.
