29 CFR 1926.451(f)(7):Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person. a. Located at lot 211 9044 Philmont Curve Drive, Blacklick Ohio 43004: On or about July 11, 2023, the employer exposed employees to falls and struck-by hazards due to the pump jack scaffolding system not being erected under the supervision and direction of a competent person. Employees were utilizing a pump jack scaffold with intermixed components not approved by the manufacturer and no guardrail system installed while installing siding materials at heights of 14 feet 8 inches.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part. a. Located at lot 211 9044 Philmont Curve Drive, Blacklick Ohio 43004: On or about July 11, 2023, the employer failed to ensure the employees working off of a scaffold plank above 10 feet from the lower level were protected from falling when installing house siding material on a two story single family home. The employees were exposed to a fall of approximately 14 feet 8 inches from the edge of the scaffold platform to the ground below.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: a. Located at Lot 211 9044 Philmont Curve Drive, Blacklick Ohio 43004: On or about July 11, 2023, the employer failed to provide training in the use of a scaffold by a qualified person in the recognition of hazards prior to the employees performing work without any fall protection system in place. Thereby exposing those employees to falls of approximately 14 foot 8 inches to the ground below.
