29 CFR  1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  location: Northeast corner of building 0n or about: 7/12/23  a) An employee, who was working at the edge of the building, was not provided with adequate fall protection. The midrail was missing. The employee was exposed to a fall of 60 feet.   NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level:  location: exterior of building, Prospect St. & Hawthorne Ave. on or about: 7/12/23  a) Employees, installing netting on a tubular welded frame scaffold, were not protected from falling. The employees were exposed to a fall of 60 feet.   NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

The employees were exposed to a fall of 60 feet.  location:  exterior of building, Prospect St. & Hawthorne Ave. on or about: 7/12/23  b) The employer did not ensure that all working levels of the tubular welded frame scaffold used by employees were fully planked.  Employees were working from the crossbraces. The employees were exposed to a fall of 60 feet.  location:  exterior of building, Prospect St. & Hawthorne Ave. on or about: 7/12/23  c) The employer did not ensure that all working levels of the tubular welded frame scaffold used by employees were fully planked.  Employees were working from the frames themselves.  The employees were exposed to a fall of 60 feet. The Rennon Construction Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.451(b)(1)), which was contained in OSHA inspection number 1643281, citation number 1, item number 1 and was affirmed as a final order on 6/26/23, with respect to a workplace located at 263 West End Ave., New York, NY 10023.  The Rennon Construction Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.451(b)(2)), which was contained in OSHA inspection number 1287604, citation number 1, item number 1 and was affirmed as a final order on 7/26/23, with respect to a workplace located at 262-264 Sullivan Place, Brooklyn, NY 11225.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access:  location:  exterior of building, Prospect St. & Hawthorne Ave. on or about: 7/12/23  a) Employees were working on a tubular welded frame scaffold. The employees were not provided with adequate access. The employees were climbing the walk through frames and crossbraces.  Note: In addition to abatement certification, the employer is required to provide abatement documentation for this item in accordance with 29 CFR 1903.19   The Rennon Construction Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.451(e)(9)(i), which was contained in OSHA inspection number 1287604, citation number 1, item number 2 and was affirmed as a final order on 7/26/23, with respect to a workplace located at 262-264 Sullivan Place, Brooklyn, NY 11225.
