29 CFR 1910.178(n)(6): Industrial truck drivers were not required to look in the direction of, and keep a clear view of the path of travel: On or about July 5, 2023, the employer failed to ensure an employee operating a powered industrial vehicle kept a clear view of the path of travel. As a result, an employee was exposed to and struck by a Toyota Forklift 7FGCU25 which led to in-patient hospitalization.

29 CFR 1910.178(n)(8): Under all travel conditions the truck was not operated at a speed that would permit it to be brought to a stop in a safe manner: On or about July 5, 2023, the employer failed to ensure employees were operating forklifts at a speed that would permit them to be brought to a stop in a safe manner. As a result, an employee was exposed to struck by hazard while standing between a building and a Caterpillar Forklift GP25K as it was struck by a Toyota Forklift 7FGCU25 which was in motion effectively pinning and injuring the employee.

OSHA was not notified of the injury until on or about July 11, 2023, via owner calling the Cleveland Area OSHA Office.
