29 CFR 1926.152(e)(4):The dispensing units shall be protected against collision damage. a) On or about 07/10/2023, during the construction of the Bank of America, located at 1500 Hudson Avenue , in Rochester, New York, the employer did not enforce safety precautions such as, installing bollards or concrete barriers to protect a 320 gallon diesel dispensing tank from potential collision damage. Employee and vendor vehicles were allowed to drive and park in close proximity of an unprotected dispensing tank. NO ABATEMENT CERTIFICATION REQUIRED
