29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation. On or about July 12, 2023, and times prior thereto, employees installing a residential roof were exposed to flying debris struck by hazards not wearing eye protection while using pneumatic nail guns.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about July 12, 2023, and times prior thereto, at the roof at a three-story residential structure under construction, employees engaged in installing a residential shingles roof were exposed to fall hazards from a height greater than six feet above ground level due to lack of fall protection. Oscar Mancinas was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.501(b)(1), which was contained in OSHA inspection number 1432754, citation number 1, item number 1 and was affirmed as a final order on March 6, 2020, with respect to a workplace located at 5626 Ocean Drive, Corpus Christi, Texas 78412. Oscar Mancinas was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1388910, citation number 1, item number 1 and was affirmed as a final order on July 16, 2019, with respect to a workplace located at 5626 Ocean Drive, Corpus Christi, Texas 78412.
