29 CFR 1926.651(k)(1):An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: On or about July 13th, 2023 Location: New development at the end of Jeremy court, (intersection of Powder Horn Dr. and Jeremy Court), Suffern, NY 10901 a) East side construction site, first day site inspection (07/13/2023). Employee was exposed to trench wall collapse due to lack of trench inspection. Employee carried out work inside a 17ft-deep trench made of almost straight up walls composed of solid rock, loose rock, and some loose soil. Trench had a trench box that only covered about half of the depth of the trench. Trench conditions were similar for the last 1.5 weeks. b) Main entrance construction site, second day site inspection (07/19/2023). Employees were exposed to trench wall collapse due to lack of trench inspection. A trench of approx. 7ft deep was dug and single benched with approx. 63.4 degrees inclination. Foreman on site did not know the type of soil classification for the trench. Soil type B was determined for that trench by OSHA technical center, so the inclination cannot be more than 45 degrees.
