29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  The employer failed to provide abatement certification for the citations issued September 21, 2022, regarding the employer not ensuring frequent and regular inspections of the jobsite are being conducted, non-self-supporting ladders used at an incorrect angle, and portable ladders not extending 3 feet above the landing surface to which the ladder is used to gain access.

29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  The employer failed to provide abatement documentation for the citation items 1-1, and 1-3, issued September 21, 2023, regarding the employer's failure to ensure frequent and regular inspections of the jobsite are taking place and portable ladders extending 3 feet above the landing surface to which the ladder is used to gain access.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On or about July 13, 2023, at the worksite located at 204 North Nash Street, Hortonville, Wisconsin; the employer did not address construction hazards by having frequent and regular inspections of the worksite by a competent person to ensure workers were following company and OSHA safety regulations to include the use of fall protection. Workers were exposed to fall hazards at a jobsite where a competent person had not adequately inspected the work areas to address and eliminate hazards.

1926.1053(b)(5)(i): Non-self-supporting ladders shall be used at an angle such that the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).  On or about July 13, 2023, at the worksite located at 204 North Nash Street, Hortonville, Wisconsin; the horizontal distance from the vertical support to the base of the extension ladder which was used by the employees to access a roof was more than one fourth (1/4) the working length of the ladder.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.   On or about July 13, 2023, at the worksite located at 204 North Nash Street, Hortonville, Wisconsin; workers were accessing a roof using a portable ladder which was not being used as it was intended.  The ladder was being supported by a lower roof surface and was being accessed approximately three to four feet above where the ladder was supported, exposing employees to falls from potential kick out and displacement from deflection caused by the extension above the supported location.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   On or about July 13, 2023, at the worksite located at 204 North Nash Street, Hortonville, Wisconsin; workers were performing reroofing activities on an approximately 7:12 pitch roof, without any form of fall protection, while exposed to a fall over 25 feet.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.   JJJ Roofing, LLC was previously cited for a repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1593075, citation 2, item 1 and was affirmed as a final order on October 7, 2022, with respect to a worksite located at 1612 North Star Court, new London, WI 54961.  JJJ Roofing, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1565476, citation 1, item 1 and was affirmed as a final order on May 5, 2022, with respect to a worksite located at W6026 Autumn Mist Trail, Appleton, WI 54913.  JJJ Roofing, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1563396, citation 1, item 1 and was affirmed as a final order on February 22, 2022, with respect to a worksite located at W5317 Birds nest Court, Appleton, WI 54913.  JJ Pipo Roofing, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1478184, citation 1, item number 1 and was affirmed as a final order on July 16, 2020, with respect to a worksite located at N9556 Lake Shore Dr., Van Dyne, WI 54979.
