29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) The Drexel Collective Luxury Apartments, Tower 8, Unit #8043, 100 Drexel Point, Atlanta - On or about June 13, 2023, the employer exposed employees to fall hazards in that, the employer failed to ensure that employees were protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems when employees were painting the balconies and railings on the 4th floor at approximately 30 feet above the ground while in the process of leaving the balcony to the ladder.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. a) The Drexel Collective Luxury Apartments, Tower 8, Unit #8043, 100 Drexel Point, Atlanta - On or about June 13, 2023, the employer failed to report within 24-hours the work-related injury resulting in hospitalization to OSHA when an employee fell from the 4th floor at approximately 30 feet above the ground, suffered injuries to his face and was hospitalized.
