29 CFR 1926.502(f)(1)(i):When no mechanical equipment was being used the warning line was not erected at least 6 feet (1.8m) from the roof edge: (a) On July 12, 2023, at 2835 13th Avenue South in Fargo, ND, employees were exposed to a fall hazard of 17 feet when employees were working outside the warning lines installing a roof lining on a flat roof when the warning lines were not set back from the roofs edge 6 feet.

29 CFR 1926.502(h)(1)(v): The safety monitor had other responsibilities which could take the monitor's attention from the monitoring function: (a) On July 12, 2023, at 2835 13th Avenue South in Fargo, ND, employees were exposed to a fall hazard of 17 feet when employees were working outside the warning lines installing a roof lining on a flat roof when the safety monitor engaged in roofing activities. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 143185, Citation 1, Item 1, and was affirmed as a final order on January 22, 2020, with respect to a workplace in the vicinity of Sheyenne Street & 32nd Avenue South, West Fargo, North Dakota.
