29 CFR  1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design:  (a) On July 12, 2023, at the jobsite located at 4710 Second Street East, West Fargo, ND employees were exposed to a fall hazard when working on a fabricated frame scaffold that was not constructed in accordance with manufacturer's design guidelines.

(a) On July 12, 2023, at the job site located at 4710 Second Street East, West Fargo, ND, employees were working on a fabricated frame scaffold that was missing base plates.

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  (a) On July 12, 2023, at the job site located at 4710 Second Street East, West Fargo, ND, employees were exposed to a fall hazard while installing shingles on a roof edge from scaffolding at heights greater than 10 feet without proper fall protection methods being used.

29 CFR  1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  (a) On July 12, 2023 and times prior, the employer did not verify compliance with paragraph (a) of this section by preparing a written certification record as required.
