On or about July 10, 2023, at the above addressed jobsite, an employee performing roofing operations on the second level below was not wearing a hard hat to protect against falling materials.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): (a)  a. On or about July 10, 2023, at the above addressed jobsite, an employee performing residential roofing operations, fifteen (15') feet nine (9") inches above the ground, was not protected from falls, thereby exposing the employee to fall hazards.  b. On or about July 10, 2023, at the above addressed jobsite, employees performing residential roofing operations, eight (8') feet ten (10") inches above the ground, were not protected from falls, thereby exposing employees to fall hazards.  GUALAN CONSTRUCTION, CORP. DBA Carlos Gualan was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1605936, citation number 1, item number 2, and was affirmed as a final order on September 7, 2022, with respect to a workplace located at 6N474 Roosevelt Ave., St. Charles, IL 60174.

29 CFR 1926.503(b)(1): The employer did not verify fall protection training by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.   a. On or about July 10, 2023, at the above addressed jobsite, employees had been provided fall training, however, the employer failed to keep a written certification record of the training.
