29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) On or about August 6, 2025, at the above addressed jobsite, an employee using a pneumatic roofing nail gun did not wear safety glasses, thereby exposing the employee to the hazards associated with eye injuries.  GUALAN CONSTRUCTION, CORP. DBA Carlos Gualan was previously cited for a violation of this occupational safety and health standard 1926.102(a)(1), which was contained in OSHA inspection number 1605936, citation number 1, item number 1, and was affirmed as a final order on September 7, 2022, with respect to a workplace located at 6N474 Roosevelt Ave., St. Charles, IL 60174.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a. On or about August 6, 2025, at the above addressed jobsite, an employee performing residential roofing operations, thirteen (13') feet five (5") inches above the ground, was not protected from falls, thereby exposing the employee to fall hazards.  b. On or about August 6, 2025, at the above addressed jobsite, an employee performing residential roofing operations, seven (7') feet ten (10") inches above the ground, was not protected from falls, thereby exposing the employee to fall hazards.  GUALAN CONSTRUCTION, CORP. DBA Carlos Gualan was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1605936, citation number 1, item number 2, and was affirmed as a final order on September 7, 2022, with respect to a workplace located at 6N474 Roosevelt Ave., St. Charles, IL 60174.  GUALAN CONSTRUCTION, CORP. DBA Carlos Gualan was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1683303, citation number 2, item number 1, and was affirmed as a final order on November 28, 2023, with respect to a workplace located at 8506 Banger Dr., Tinley Park, IL 60477.  GUALAN CONSTRUCTION, CORP. DBA Carlos Gualan was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1773673, citation number 1, item number 1, and was affirmed as a final order on December 17, 2024, with respect to a workplace located at 7305 W. Lakeside Dr., Frankfort, IL 60423.
