29 CFR 1910.22(d)(1): The employer did not ensure that walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition.  On or about July 14, 2023, employees were exposed to tripping and ergonomic hazards while being required to push picking carts, between E5-22/ E5-23 and F3-10/F3-11 in the warehouse, along a damaged floor.  The employer did not ensure that the walking working surface was being inspected, regularly and as necessary and maintained in a safe condition.  Abatement certification is required of this item in accordance with 29 CFR 1910.1903(c).

29 CFR  1910.138(a):The employer did not select and require employee(s) to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances, severe cuts or lacerations, severe abrasions, punctures, chemical burns, thermal burns, and harmful temperature extremes.  On or about August 20th, 2023, employees were adding distilled water to the battery of powered industrial vehicle using non acid resistant nitrile gloves. Employees were exposed to corrosive substance such as sulfuric acid to both their hands and body. The employer did not select and require employees to use appropriate hand protection when employees' hands were exposed to hazards such as chemical burn.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.132(d)(1):  The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE).   On or about August 20th, 2023, employees were adding distilled water to the battery of powered industrial vehicle using non acid resistant nitrile gloves.  Employees were exposed to corrosive substance such as sulfuric acid both their hands and body.  The employer did not assess the workplace to determine if hazards are present, which necessitate the use of proper personal protective equipment (PPE).  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:   On or about August 20th, 2023 , employees providing maintenance to the powered industrial vehicles were exposed to respiratory and chemical hazards, such as but not limited to, propane gas and battery acid.  The employees were not provided with effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.151(c):Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use.   Battery Charging Station:  On or about August 20th, 2023, employees were adding water to the battery of a powered industrial vehicle and were exposed to corrosive materials, such as sulfuric acid.  There were no suitable facilities in the vicinity of the battery charging station to quickly drench the skin of the employees in the event of exposure to corrosive substances.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
