29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about July 17, 2023 at a worksite located near 6160 Brecksville Road, Independence, OH 44131: during commercial bricklaying activities, the employer did not ensure employees were protected from possible head injuries by ensuring head protection was worn during exposure to overhead hazards.

29 CFR  1926.451(f)(6): Scaffolds were erected, used, dismantled, altered, or moved such that they, or any conductive material handled on them, could have come closer than the minimum distances established for specific voltages as set forth in the table in subparagraph (f)(6):  On or about July 14, 2023, the employer did not ensure metal tubular scaffolding was erected and used at least 10 feet away from power transmission 120/208 secondary voltage lines on the building. Employees were performing bricklaying operations from the fabricated frame scaffolding that was closer than 10 feet to the energized secondary voltage lines.

The employees were working from a supported scaffold and the employer was not a competent person qualified for scaffolding.

29 CFR  1926.451(e)(9)(iv): Cross braces on tubular welded frame scaffolds were used as a means of access or egress:   On or about July 14, 2023,  employees were exposed to a fall of approximately 14 feet while performing masonry activities on a commercial building located near 6160 Brecksville Road, Independence, Ohio 44131. The employees were observed climbing the cross braces on a supported scaffold and not using a proper access/egress method.
