29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  On June 10, 2023, employees of DBY Construction LLC, dba: Sergio Mejia were constructing the leading edge of a building located at 20 Cliff View Drive in Wentzville, Missouri.  The employer did not ensure employees had been adequately trained to recognize or avoid hazards such as but not limited to compressed air tools, extension cords, aerial lifts, and other hazards associated with a construction site.  Employees are being exposed to serious and life-threatening hazards while working at elevations of approximately 44 feet while using construction tools and equipment.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above the lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  On June 10, 2023, employees of DBY Construction, LLC, dba: Sergio Mejia, were constructing the leading edge of a building located at 20 Cliff View Drive in Wentzville, Missouri.  The employer did not ensure that employees utilized fall protection systems while working at heights of approximately 44 feet above the lower level. Employees were exposed to fall hazards.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.:  On June 10, 2023, employees of DBY Construction LLC, dba: Sergio Mejia were constructing the leading edge of a building located at 20 Cliff View Drive in Wentzville, Missouri.  The employer did not ensure employees exposed to fall hazards had been trained to recognize the hazards of falling and the procedures to be followed to avoid those hazards. Employees were working on a four story building approximately 44 feet above the lower level exposing themselves to fall hazards.
