29 CFR 1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: On or about July 03, 2023, the employer did not ensure that modifications that affected the safe operation of the Toyota (7FGCU25) forklift were performed with the manufacturer's prior written approval. The employer fabricated a rigging device made of a chain and rebar to fasten the "FOD" panel to the forklift. As a result, employee(s) were exposed to the struck-by hazards during PIV operations.

As a result, employee(s) were exposed to the struck-by hazards associated with falling loads that were not stable or safely arranged during PIV operations.
