29 CFR 1917.43(b)(1):After October 3, 1983, modifications, such as adding counterweights, that might affect the vehicle's capacity or safety were performed without either the manufacturer's prior written approval or the written approval of a professional engineer experienced with the equipment who has consulted with the manufacturer, if available. Capacity, operation and maintenance instruction plates, tags or decals shall be changed to conform to the equipment as modified. (a)11040 North Lombard Street, Terminal 4, Portland, Oregon 97283, on or about July 17, 2023 and at times prior thereto, Employees were exposed to struck by, crush by hazard from a modification of the power industrial truck carriage assembly, forks locking mechanism that was performed without either the manufacturer's prior written approval or the written approval of a professional engineer experienced with the equipment who has consulted with the manufacturer, in that the welded bar was substituted for the manufacturers original design.

(a)11040 North Lombard Street, Terminal 4, Portland, Oregon 97283, on or about July 17, 2023, and at times prior thereto, employees were exposed to crush by/ struck by hazard due to plasticky glass covers on overhead guards on power industrial trucks obstructs operators view of elevated loads operations creating potential loss of control of elevated loads . Resulting in serious injuries, disabilities, and death.
