29 CFR  1926.451(e)(1):When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used for access:   a.) Site: Site: 23-30 Borden Avenue, Long Island City, NY 11101. On or about July 15, 2023, employees laying bricks on a supported frame scaffold did not have a mean of access or egress to the scaffold. The working level was approximately 12 feet from the ground level.   Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1926.451(b)(1): Each platform on all working levels of scaffolding was not fully planked or decked:  Site:23-30 Borden Avenue, Long Island City, NY 11101. a.) On or about July 15, 2023, employees were working from the 2nd tier platform of a supported scaffold, approximately 12-feet above the lower level.  The platform was missing two planks, creating a gap of 16 inches.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19

Site: 23-30 Borden Avenue, Long Island City, NY 11101. a.) On or about July 15, 2023, employees laying bricks from a supported scaffold were not protected from falls by the used of personnel fall arrest systems or guardrails systems.   Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19

Site: 23-30 Borden Avenue, Long Island City, NY 11101. a.) On or about July 15, 2023, employees working on a supported frame scaffold were exposed to fall hazards. The employer did not provide hazard recognition training to employees installing bricks from a supported frame scaffold.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1904.39(a)(2): Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, the employer failed to report the in-patient hospitalization to OSHA.  Site: 23-30 Borden Avenue, Long Island City, NY 11101. a.) On or about July 15, 2023, An Employee fell from a scaffold and suffered multiple fractures and lacerations and was transported to the local hospital for treatment. The in-hospitalization was not reported to OSHA.   Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19
