29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) Worksite, Apartment Balcony - On or about July 22, 2023, an employee was performing work on the fourth floor balcony of a new apartment building approximately 50-feet above the ground. The employee had no means of fall protection and was exposed to fall hazards. b) Worksite, Apartment Balcony - On or about August 18, 2023, an employee was performing work on the fourth floor balcony of a new apartment building approximately 50-feet above the ground.
