Located at 22300 State Park Road, Mount Sterling, Ohio, 43143: On or about July 18, 2023 . the employer failed to ensure that the employees had been properly trained, evaluated, and certified in the use of a JCB forklift. The employees were seen delivering materials onto a roof using this JCB forklift for several minutes prior to the inspection.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. Located at 22300 State Park Road, Mount Sterling, Ohio, 43143: On or about July 18, 2023, the employer failed to ensure the employees were protected by way of a guardrail system, safety net system, or personal fall arrest system while the employees were working to unload material, install the siding material, and install the roofing materials. Thereby exposing these employees to a minimum fall of approximately 23 feet from the roofs edge to the ground below.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. a.
