29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment (PPE).  If such hazards were present, or likely to be present, the employer did not: (i) Select, and have each affected employee use, the types of PPE that would protect the affected employee from the hazards identified in the hazard assessment; (ii) Communicate selection decisions to each affected employee; and (iii) Select PPE that properly fit each affected employee:  a) Outside right of the building, on or about July 19, 2023, and at times prior, the employer exposed employees to chemical burns, in that the employer did not provide appropriate personal protection equipment (PPE) for the body when changing propane tanks.

29 CFR  1910.1200(h)(3): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.  a) Right side of building outside, on or about July 19, 2023, and at times prior, the employer exposed employees to chemical hazards, including but not limited to, propane, in that the employer did not develop, implement, and/or maintain, an effective written hazard communication program for changing out propane tanks on forklifts.
