29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  Neptune Drive, Brunswick- The employer did not ensure that the employees conducting trenching and excavation work around a charged natural gas line were properly trained in the hazards of the operations including fire and/or explosions related to the natural gas lines, trench collapse, and precautions to avoid those hazards.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  Neptune Drive, Brunswick - The employer did not ensure a competent person was onsite to conduct daily inspections of excavation of trenching activities that contained groundwater buildup and a two-inch charged natural gas line.

29 CFR  1926.651(b)(2): Utility companies or owners were not contacted within established or customary local response times, advised of the proposed work, and asked to establish the location of the utility underground installations prior to the starting excavation work.  Neptune Drive, Brunswick- The employer did not contact the public utilities to mark a buried natural gas line to ensure that employees excavating multiple trenches were aware of the specific location of the gas line.  The gas line crossed multiple trenches dug by the employer that was excavating to install residential water service lines and this gas line was severely damaged over the course of three days by the employer's excavation activity.

29 CFR  1926.651(b)(3): When excavation operations approached the estimated location of underground installations, the exact location of the installations was not determined by safe and acceptable means:  Neptune Drive, Brunswick- The employer did not use a safe and acceptable means of to identify the location of the a 2 inch natural gas line during soil removal around ten trenches resulting in significant damage to the line from an excavator and shovel strikes over the course of three days.
