OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and falling object hazards during use of overhead chain hoist(s). a) Wash Bays: The employer did not inspect and document inspection of the three CM Series 622 hoists for defects at routine intervals. Observed on or about 7/20/23. b) Wash Bay 5: The employer used a 3M DBI SALA Fall Protection Trolley Anchor to attach a CM 622 hoist to a monorail beam ; the fall protection anchor is not designed for use in this application Observed on or about 7/20/23. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
