(i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:  (a) On or about July 20, 2023,  at 4750 South 10th Street Milwaukee, WI 53221, employees loading a mixing bin/hopper with bags of industrial plaster dry mix on the equipment mezzanine above the plaster mixing area were not protected from falling to the lower level. This exposed employees to fall hazards approximately 5 feet height from mezzanine to concrete.

29 CFR  1910.134(d)(1)(iii):The employer shall identify and evaluate the respiratory hazard(s) in the workplace; this evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form. 29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.  a.  On or about July 20, 2023, at 4750 South 10th Street Milwaukee, WI 53221, employees were exposed to approximately one inch of an unguarded ban saw blade when cutting three stacks of foam products with the guard on the band saw blade all the way in the up position exposing employees to an amputation hazard.

29 CFR  1910.178(q)(7):Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  a) On July 20, 2023 at Above View Inc. located at 4750 South 10th Street Milwaukee, WI 53221,  the employer did not ensure pre- shift inspections were completed prior to operating powered industrial trucks, exposing employees to hazards associated with faulty equipment.

Hazardous chemicals that are known to be present in this facility include, but are not limited to:  industrial plaster, Superpaint- industrial latex satin, PROMAR 200 Zero VOC Interior Latex Primer.

29 CFR  1910.1200(h)(1):Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  a) On July 20, 2023, employees of Above View Inc. were exposed to industrial plaster, Superpaint- industrial latex satin, PROMAR 200 Zero VOC Interior Latex Primer, in their workplace and had not received training on health hazards of the chemicals present in the work area.
