29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 7/16/2023 at a roof project located at South Drive. Lot 18B/A, Lackawanna, New York; employees were shingling a new roof of a two story house. The roof had an 5 in 12 pitch and an eave height of approximately 20 feet. There was no fall protection in use. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) On or about 7/16/2023 at a roof project located at South Drive. Lot 18B/A, Lackawanna, New York; employees were placing shingles on the roof of a new house. Employees were using an extension ladder to access the work area on the roof. The ladder extended 1 foot above the landing surface. NO ABATEMENT CERTIFICATION REQUIRED North Clymer Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1623068, citation number 1, item number 2 and was affirmed as a final order on 10/17/22, with respect to a workplace located at 135 & 137 South Drive, Lackawanna, New York.
