29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) On or about January 29, 2024, the employer failed to submit documentation of corrective action for citation #1, item #1, issued on 1/11/2024 with an abatement due date of 01/11/2024.  (b) On or about January 29, 2024, the employer failed to submit documentation of corrective action for citation #1, item #2, issued on 1/11/2024 with an abatement due date of 01/11/2024.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a.) At the jobsite located at 16480 Athens-Limestone Blvd., Athens, AL: On or about 07/20/2023, employees were exposed to a 40 ft. fall hazard while walking the purlins of the roof when setting trusses, in that fall protection was not being worn.   b.) At the jobsite located at 16480 Athens-Limestone Blvd., Athens, AL: On or about 07/20/2023, employees were exposed to a 14 ft. fall hazard while working on the porches of the 2nd story of apartment building, in that fall protection was not being worn.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.503(c)(3):Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  a. At the jobsite located at 16480 Athens-Limestone Blvd., Athens, AL: On or about 07/20/2023, employees were exposed to fall  hazards while working at heights above 6 feet, conducting frame work activities ,in that fall protection was not properly secured.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
