OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  On or about July 21, 2023, and at times prior to, two automotive lifts, BendPak automotive lift model HDS-14LSXE and Rotary automotive lift model SPOA10N700, that had broken locking mechanisms/keepers, hydraulic leaks, and bent rollers/pulleys that caused failed lifts or uneven lifting exposed employees to struck-by and crushing injuries.

29 CFR  1910.106(a)(29):  Safety can shall mean an approved container, of not more than 5 gallons capacity, having a spring-closing lid and spout cover and so designed that it will safely relieve internal pressure when subjected to fire exposure:  On or about July 21, 2023, and at times prior thereto, employees engaged in automotive mechanic activities were exposed to fire hazards when using plastic gasoline containers without spring-closing lid and spout cover.

29 CFR  1910.151(c):  Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  On or about July 21, 2023, and at times prior thereto, employees engaged in automotive mechanic activities were exposed to hazardous chemicals, such as, but not limited to, BG Universal Cooling System Cleaner, and Imperial Degreaser and Brake Parts Cleaner III, without access to an eyewash station within the work area for immediate emergency use.

29 CFR  1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  On or about July 21, 2023, and at times prior thereto, in the shop, employees engaged in automotive mechanic activities were exposed to hazardous chemicals, such as, but not limited to, BG Universal Cooling System Cleaner and Imperial Degreaser and Brake Parts Cleaner III.    The employer had not developed a program which would address labeling and other forms of warning on chemical containers, Material Safety Data Sheets, and employee information and training on the hazards associated with chemicals utilized at this site.    The written program must also contain the following:    a.  a list of all hazardous chemicals on site,    b.  the methods the employer will use to inform employees of the hazards of non-routine tasks involving chemicals, such as a spill,  c.  the hazards of chemicals stored onsite, and    d.  the method the employer will use to inform other employers (contractors) of the chemicals their employees might be exposed to while performing duties at this site.
