29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered: Warehouse Exterior: On or about July 25, 2023, six-foot extension attachments were out for ready use. The Case Corp 588G forklift factory equipped with four-foot forks uses the six-foot extensions when lifting larger pallets within the warehouse yard. The forklift's data plate did not provide information on the compromised load capacity when using the six-foot extension, thus exposing employees to struck by or crushing hazards.

29 CFR 1904.40(a): The employer did not provide an authorized government representative the records within the four business hours: On or about July 25, 2023, the employer failed to provide copies of the injury and illness records to an authorized representative upon request on four separate occasions between July 25 - August 2, 2023. After several attempts to obtain the information, the employer finally produced the documentation on August 3, 2023.
