29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access.      a- 2 Hetzel Drive, Mahwah NJ 07430 (Residential Roof): CSHO observed employees engaged in roofing activities using aportable extension ladder in which employees were exposed to fall hazards as the ladder side rails did not extend 3ft above the upper landing surface.  Observed on or about 07/25/2023.

29 CFR 1926.102(a)(1): 29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.   a- 2 Hetzel Drive, Mahwah NJ 07430 (Residential Roof): CSHO observed employees engaged in roofing activities using Hitachi Pneumatic nail guns exposed to eye loss and eye injury due to struck by hazards as eye protection had not been utilized.  Observed on or about 07/25/2023.  AAV Construction LLC was previously cited for serious violations of this Occupational Safety and Health standard or its equivalent standard, 29 CFR 1926.102(a)(1): which was contained in OSHA Inspection Number 1376104, Citation # 1, Item # 2, issued on 02/11/2019 with respect to a workplace located at 66 Pearl Street, Paterson NJ 07501. This citation became a final order on 04/30/2019.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b)(1)  a- 2 Hetzel Drive, Mahwah NJ 07430 (Residential Roof): CSHO observed employees engaged in roofing activities on a 8 on 12 pitch roof in which a means of fall protection was not being utilized exposing the employees to fall hazards of approximately 15 and 25ft to the asphalt below. Observed on or about 07/25/2023.
