The employer had not identified and documented, in a list, job classifications and the respective tasks and procedures assigned to them, in which employees are reasonably anticipated to come into contact with blood or other potentially infectious material during the performance of their duties.

29 CFR 1910.1030(c)(1)(iv)(B): The review and update of the exposure control plan did not document annually consideration and implementation of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure: (a) On or about July 25,2023 and prior to; phlebotomists and medical technicians are exposed to blood or other potentially infectious material during the blood culture collection procedure when using a hypodermic syringe to directly puncture the rubber septum of a blood culture tube which is held in plastic tube racks. The employer failed to perform a thorough hazard assessment and document the feasibility and appropriateness for use of engineering controls before instituting its use.
