29 CFR  1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided.  On July 24, 2024, the employer did not provide an extension ladder where employees could access and egress the residential building roof level, exposing them to potential fall hazards.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  On July 24, 2024, employees engaged in decking activities without fall protection were exposed to unprotected fall hazards of approximately 16 feet to the ground below.   Jose Valdez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1501293, citation number 01, item number 002 and was affirmed as a final order on January 20, 2021, with respect to a workplace located at 7628 Sonian Forest Drive, Irving, Texas 75063.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    On July 24, 2024, employees engaged in decking activities without fall protection were not provided a training program with formal training to understand and obtain the knowledge and skills to recognize the hazards and how to eliminate the hazards.
