29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about July 25, 2023, employees were allowed to climb the Crossbraces as a form of access and egress from the scaffold. This condition exposed employees to fall hazards greater than 10 feet to the ground level.

For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. On or about July 25, 2023, an employee was dry-cutting cinder blocks for the exterior of a new commercial building under construction without any respiratory protection or other engineering controls, this condition exposed the employee to hazards of respirable crystalline silica.
