29 CFR  1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  a. Located at 8957 Thornton Hall Boulevard, lot B2, Reynoldsburg, Ohio 43068: On or about July 27, 2023, the employer failed to ensure that the person operating the Skytrak model 10054 all-terrain forklift had completed training prior to operating the equipment on the jobsite.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.   a. Located at 8957 Thornton Hall Boulevard, lot B2, Reynoldsburg, Ohio 43068: On or about July 27, 2023, the employer did not ensure that framers working at heights above 6 feet with open sided floor were protected from falls.  Employees were working on a second story landing  walking and leaping from one 2x4 board to another without any form of fall protection in place thereby exposing the employees to falls over 9 feet.  Jose Lagunas  had been previously cited under the name Lagunas Construction LLC DBA Jose Lagunas for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1629562, citation number 1, item number 4 and was affirmed as a final order on March 14, 2023 , with respect to a workplace located at 2595 Serenity Lake Lane, Building #13 and #14, Columbus Ohio 43219.

29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at 8957 Thornton Hall Boulevard, lot B2, Reynoldsburg, Ohio 43068: On or about July 27, 2023,  the employer did not initiate and maintain accident prevention programs that included work rules, training, inspections and enforcement at a residential construction site where an employee was exposed to fall and struck-by hazards.   Employees were working on the second deck of a residential building at heights of over 9 feet without fall protection and utilizing a forklift without proper training which exposed the employees to fall and struck-by hazards.  Jose Lagunas was previously cited under the name Lagunas Construction LLC DBA Jose Lagunas for a violation of this Occupational Safety and Health standard 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1629562, citation number 1, item number 1 and was affirmed as a final order on March 14, 2023 , with respect to a workplace located at 2595 Serenity Lake Lane, Buildings #13 and # 14.
