29 CFR  1910.178(q)(1):Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:  a.)	ErieTec, a division of Purvis Industries, Warehouse area, on or about July 27th, 2023 and times prior thereto:  Employees utilized a liquid propane powered Caterpillar (Model T40E/Serial # 2ND00850) industrial truck throughout the warehouse areas of the facility.  The Caterpillar powered industrial truck was exhausting Carbon Monoxide at levels up to, and including, 190 parts per million and needed mechanical repair.  b.)	ErieTec, a division of Purvis Industries, Warehouse area, on or about July 27th, 2023 and times prior thereto:  Employees utilized  a liquid propane powered Caterpillar (Model T40E/Serial # 2ND00850) industrial truck throughout the warehouse areas of the facility.  The Caterpillar powered industrial truck was leaking hydraulic fluid from the mast area and was in need of mechanical repair.   ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

ErieTec, a division of Purvis Industries, Warehouse area, on or about July 27th, 2023 and times prior thereto:  Employees worked with and around hazardous substances including, but not limited to, liquefied propane (carbon monoxide) during forklift operations.  A worksite specific hazard communication program had not been developed and implemented.  The employers hazard communication program was lacking worksite specific information including, but not limited to the following:  1)  A list of the hazardous chemicals known to be present onsite; 2) The method the employer will use to provide employees with hazard communication training; 3) The hazard communication program referenced Material Safety Data Sheets throughout the documentation versus Safety Data Sheets.  In addition the program did not demonstrate how employees would obtain access to the company's Safety Data Sheets and; 4) Information regarding how labeling for hazardous products would be conducted onsite.   ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
