29 CFR  1910.134(c)(1):In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use.   On or about July 27, 2023, the employer did not provide a respiratory protection program for employees engaged in welding and metal fabrication that were exposed to respiratory hazards from materials, such as the following but not limited to high speed steel-cobalt and steel blue layout fluid, in the following instance:  a. Building #2- Manual machine operations-employees are engaged in the welding operations of different metals. b. Building #3-CNC Machines-employees are engaged in the machining operations of different metals using the CNC machines. c. Building#4- Welding Area-employees are engaged in the welding operations with different metals.

29 CFR  1910.134(c)(2)(i):  An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard")  On or about July 27, 2023, employees engaged in welding and metal fabrication were not provided with the information contained in Appendix D as required where employees work with materials, such as the following but not limited to high speed steel-cobalt, in the following instance:  a. Building #2- Manual machine operations-employees are engaged in the manual operations of different metals with N-95 or cartridge half-masks. b. Building #3-CNC Machines-employees are engaged in the  operations of different metals with N-95 mask.   c. Building#4- Welding Area-employees are engaged in the welding operations on different metals N-95 mask.

29 CFR  1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  On or about July 27, 2023 employees engaged in the metal fabrication were exposed hazards due to guarding not provided in following instances:   a. Horizontal Band Saw 605 Model PA13/3FPC, Serial EPA130946EPC missing guard on approximately 2 inches of the unused portion of the blade on right side of point of operation exposing employees to amputation hazard. b. Vertical Milling machine (Bridgeport), Serial No 2J134715 missing guard on rotating parts and flying chips exposing employees to struck-by hazards.

29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  On or about July 27, 2023, the employer did not provide employees engaged in welding and using chemicals such as cutting oil, oxygen and acetylene a written hazard communication program with all the required elements.

29 CFR  1910.1200(f)(6)(ii): Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.   On or about July 27, 2023, employees engaged in welding and the handling of metal were exposed to chemical hazards due to the employer not ensuring each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein. Some of the chemicals used without labels, but not limited too, was aluminum putty resin and bronze putty resin which exposed employees to skin corrosion and eye irritation.

29 CFR  1910.303(b)(1)(vii):Classification by type, size, voltage, current capacity, and specific use  On or about July 27, 2023, employees working on building #2 and building #3, manual machine operations, were exposed to electrical hazards due to the electrical boxes not being marked with the required information.  a. Building # 2, electrical box next to the Victor machine, did not have the danger sign and did not have the use.  b. Building# 3, to the back of the building, electrical box did not have the info about the use (what machines are controlled from the box).
