29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize or eliminate the hazards: (a) On or about July 25, 2023, the employer had not provided a training program for those employees conducting framing work to include decking while exposed to a fall hazard of ten (10) foot, three (3) inches. This program would include providing employees with adequate knowledge in the recognition of fall hazards and the implementation of the appropriate fall protection system.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about July 25, 2023, employee(s) conducting roof decking work on a 6:12 pitch new construction roof were not protected from falling to the lower level. This exposed the employee(s) to a fall hazard of approximately ten (10) feet, three (3) inches on the south side of the roof onto dirt and gravel when employees were not tied into the available fall protection system. Melesio Zacarias Construction LLC. dba MZ Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1452904, citation number 1, item number 2 and was affirmed as a final order on 02-11-2020, with respect to a workplace located at LOT 370 Acadia Dr. SOUTH BARRINGTON, IL, 60010.
