For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.   On or about July 25,2023, at an exterior building wall, toe boards, or other protective devices, were not installed at a 2-tier supported scaffold where employees did bricklaying and were exposed to struck-by hazards from falling objects including but not limited to bricks, hand tools, scaffold planks.

29 CFR  1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).   On or about July 25, 2023, at an exterior building wall, the top scaffold platform of a 2-tier supported scaffold lacked guardrails. An employee performed overhand bricklaying at heights greater than 10 feet and was not in use of fall protection.
