29 CFR 1910.23(b): General requirements for all ladders. The employer must ensure: 29 CFR 1910.23(b)(8): (8) Ladders are used only for the purposes for which they were designed; a. On or about July 28, 2023 and days prior, employees used the Louisville, 12 foot fiberglass ladder in the folded position to access the roof top to conduct work on the packer blower. The employees were exposed to a fall hazard of 8 feet 3 inches to the gravel ground level as a result.

29 CFR 1910.28(b)(1)(i): (1) Unprotected sides and edges. (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: a. On or about July 28, 2023 and days prior, employees accessed the rooftop when they retrieved the packer blower filter without being protected from falling to the ground level. The employees were exposed to a fall hazard of 8 feet 3 inches to the dirt ground level as a result.
