29 CFR  1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  On or about July 26, 2023, an employee was exposed physical hazards from the operation of a rough terrain forklift, without first receiving forklift operator training and evaluation in accordance with 1910.178(l).  This training would include:  a.	 Formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), b.	Practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and  c.	Evaluation of the operator's performance in the workplace.

29 CFR  1926.503(a)(1):  The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about July 26, 2023, an employee was exposed to fall hazards in excess of 10 feet without fall protection, while performing framing operations, on a residential construction site in Urbana, Illinois. The employer did not provide construction safety training to the employee, in order to provide him with the knowledge necessary to recognize the hazards of falling and the safety requirements associated with fall protection, as well as the proper work procedures to follow, in order to minimize and eliminate the fall hazards.
