29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   a) Jobsite located at 29-45 Poplar St and 918-80 Delaware Ave, Philadelphia, PA.: The employer did not ensure that each employee using portable power tools to cut stone outdoors was instructed to recognize and avoid unsafe conditions applicable to his environment in order to control or eliminate exposure to impalement hazards, or other exposure to illness or injury. 29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) Jobsite located at 29-45 Poplar St and 918-80 Delaware Ave, Philadelphia, PA.: The employer did not ensure that employees operating a handheld power saw such as a Husqvarna circular saw Model K770 to cut stones outdoors used an integrated water delivery system as an engineering control required by Table 1, (ii) Handheld power saw.   Condition was noted on or about July 31, 2023  b) Jobsite located at 29-45 Poplar St and 918-80 Delaware Ave, Philadelphia, PA.: The employer did not ensure that employees operating an electric jackhammer such as Bosch 11335K Jack Breaker Hammer etc. to cut stone outdoors used an integrated water delivery system or dust collection system as an engineering control required by Table 1, (x) Jackhammer and handheld chipping tools.   Condition was noted on or about July 31, 2023.
