29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) On or about July 31, 2023 and at times prior thereto, employee exposure to noise in the production areas exceeded 85 dBA as measured by CSHO (see HEA) and the employer had not developed a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o). Although the employer provides effective hearing protection for the employees, none of the other required elements of 29 CFR 1910.9(c) through (o) had been implemented, including monitoring, training, and audiometric testing of employees.

29 CFR 1910.1200(e)(1): The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met: (a) On or about July 31, 2023 and at times prior thereto, a written hazard communication program did not exist at the workplace to address the use of hazardous chemicals in the workplace, including Methyl Ethyl Ketone (2-butanone).
