29 CFR  1926.62(d)(1)(i):Each employer who had a workplace or operation covered by 29 CFR 1926.62 did not initially determine if any employee was exposed to lead at or above the action level of 30 micrograms per cubic meter of air (30 �?g/m3) calculated as an 8-hour time-weighted average (TWA):  a)	Norfolk Naval Shipyard Building 261: On or about June 22, 2023, subcontractor employees were tasked to remove lead-based paint roof stiffener and weld structural supports onto the stiffener without the employer conducting an initial determination to see if any employee would be exposed at or above the action level.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.62(d)(2)(v): Until the employer performed an employee exposure assessment as required under paragraph (d) of this section and determined actual employee exposure, the employer did not provide to employees performing the tasks described in paragraphs (d)(2)(i), (d)(2)(ii), (d)(2)(iii), and (d)(2)(iv) of this section with interim, appropriate respiratory protection in accordance with paragraph (f) of this section:   a)	Norfolk Naval Shipyard Building 261: On or about June 22, 2023, subcontractor employees were tasked to grind lead-based paint from roof stiffeners and weld structural supports onto the stiffeners without respiratory protection.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:  a)	Norfolk Naval Shipyard Building 261 annex: On or about July 13, 2023, extension cords and a triple tap outlet portable GFCI line cord used by subcontractors were not used in accordance with its listing and labeling in that cords were daisy chained together to supply power to temporary lights.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.405(a)(2)(ii)(C): Receptacles for uses other than temporary lighting was installed on branch circuits which supplied temporary lighting:   a)	Norfolk Naval Shipyard Building 261 annex: On or about July 13, 2023, temporary lights were installed in the overhead and plugged directly into wall receptacles used to supply power to portable electrical equipment.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
